Lewis and Roca successfully represented a client that is in the business of processing credit card transactions for the hotel industry. The client had purchased software from the defendants. Our client sued the company and its principals for fraud and other claims asserting that the defendants did not own the software at issue and had wrongfully appropriated the software from another company. For purposes of trial, the case was bifurcated. In April 2007, and after a three week jury trial in the United States District Court, we obtained a unanimous verdict that the defendants did not own the software it had sold to our client. The second trial was held in August 2009. After a three week trial, we obtained a unanimous verdict in the District Court on the client's fraud and other claims and the jury awarded nearly $5 million in damages.
