About Michael Lynch

Mr. Lynch is a trial attorney who focuses his practice on corporate litigation, and has extensive first chair litigation experience. Mr. Lynch also has great experience obtaining, maintaining, and successfully resolving receiverships for both multi-family housing and commercial properties, in addition to bankruptcy and bankruptcy-related litigation.

Representative Cases/Matters

  • Successfully first-chaired a 4-day civil trial, obtaining 57 findings of fact and conclusions of law in favor of client by proving fraud, alter-ego, civil conspiracy, misrepresentation, and conversion against the borrower and his related entity. Also proved a licensed escrow agent breached his fiduciary duty and had conspired with borrower in connection with the underlying secured loan. Obtained $100,000.00 in punitive damages against the borrower and $50,000.00 against the licensed escrow against and his escrow company in addition to attorney’s fees.   • Successfully first-chaired a 4-day arbitration, obtaining decision and confirming judgment for client by proving managing general partner had improperly withheld limited partner’s rightful share of a distribution upon dissolution of a partnership. Ronald Clark vs. James Donofrio et al., Eighth Judicial District Court, State of Nevada, Case No. A533873.
  • Successfully obtained and managed receivership appointment involving a property consisting of over 130 rental townhomes. Recently obtained court approval for the sale of that property out of receivership for approximately $9.5 million. U.S. Bank vs. Palmilla Development Company, Eighth Judicial District Court, State of Nevada, Case No. A595321.
  • Successfully defended financial advisors in 3-day administrative evidentiary proceeding before the Financial Industry Regulatory Authority (FINRA) (formerly known as NASD) for alleged violations of a non-solicitation agreement.
  • Successfully represented bankruptcy trustee by litigating over 30 adversary proceedings in case involving tens of millions of dollars in assets and claims.
