Lewis and Roca Gets Jury Verdict on Behalf of Cooper Tire, Discount Tire

Lewis and Roca won a jury verdict on behalf of Cooper Tire & Rubber Company and Discount Tire Co., Inc. in a product liability lawsuit where a Tucson woman alleged serious injuries she sustained in a rollover accident were due to an improperly designed and manufactured tire.

Cooper Tire and Discount Tire denied the tire was defective, presenting evidence that it failed due to preexisting, road hazard damage.

During closing arguments in the month-long trial, the plaintiff's attorney asked the jury to award compensatory damages of $10 million. The jury rendered a verdict in favor of Cooper Tire and Discount Tire, finding that the tire was not defective in design or manufacture, nor were the Defendants negligent.

Foster Robberson, a partner in our litigation department, was trial counsel for Cooper Tire and Discount Tire, along with Steven D. Jansma and Troy L. Vancil of Fulbright & Jaworski. Other Lewis and Roca attorneys on the trial team were Larry Kasten of our appellate department, who was responsible for legal issues arising during the trial, and William Voit, an associate. Lewis and Roca provided other necessary staffing during the trial including through Anne Saletta, our nurse legal consultant, and others.
